DutchSpark CMS Terms and Conditions
These terms apply to the use of DutchSpark CMS, additional website management services, support, hosting-related connections and white-label services, unless otherwise agreed in writing.

1. Definitions
DutchSpark: provider of DutchSpark CMS and related services. Customer: organisation, reseller, agency or end customer that enters into an agreement or uses the service. CMS: the management environment for existing websites. Website: the connected website, files, pages, images and content. Reseller: a party that offers CMS services under its own brand name or as an intermediary.
2. Applicability
These terms apply to quotations, agreements, subscriptions, demos, pilots, support, implementation, white-label services and use of DutchSpark CMS. Deviations apply only when confirmed in writing.
3. Nature of the service
DutchSpark CMS is intended for the secure management of existing websites. The service focuses on content management, images, basic SEO data, preview, backups, rollback, optimisation advice and AI-assisted proposals. DutchSpark CMS is not a fully unrestricted design program such as a visual designer, unless a separate design or custom service has been agreed.
4. Access and authority
The customer confirms that they are authorised to manage the connected website and to give DutchSpark access to files, folders, FTP/FTPS/SFTP details or local server paths. The customer remains responsible for the accuracy of the credentials provided and for internal consent from their own organisation, customers or clients.
5. Website connections
Websites can be connected through local Plesk/vhost paths, FTP, FTPS or SFTP. The selected connection is used for scanning, preparation, saving, backups, publishing and rollback. DutchSpark may perform technical checks to assess reachability, write permissions, preview and file structure.
6. Preparing editable fields
When preparing a website, the CMS may add technical markers to safe text or image blocks. This action requires separate confirmation. A backup is created in advance. Complex code, scripts, core files, vendor files and marked no-CMS blocks are skipped wherever possible.
7. Publishing, backups and rollback
Publishing is preceded by an automatic backup. Rollback may be offered per file or backup moment. Backups are intended as a recovery option within the CMS workflow and do not replace a complete hosting, server or disaster-recovery backup.
8. AI assistance
AI functions provide proposals for text, metadata, keywords, alt text, calls to action and optimisation. AI does not publish independently. Changes are applied only after selection or confirmation in the editor and go live only after publishing with a backup. The customer remains responsible for checking accuracy, claims, copyrights, trademarks and the legal suitability of AI output.
9. White-label and reseller use
With white-label use, a reseller may display its own brand name, logo, colours and support details. DNS, domain connections, SSL and correct customer communication also depend on the reseller or domain administrator. DutchSpark may provide instructions but is not responsible for incorrect DNS settings outside its own control.
10. Subscriptions, prices and payment
Plans, limits, rates and payment arrangements are stated in the quotation, plan page, invoice or additional agreement. Upgrade and downgrade requests can be prepared in the CMS. A plan change becomes final only after confirmation by DutchSpark or automatic processing through an active payment module.
11. Support and communication
Support for CMS-related questions is provided through the support form or through a customer portal connected at a later stage. Support includes reasonable assistance with use, connection, publishing and recovery within the agreed service. Custom work, redesign, emergency recovery, malware recovery or complex migrations may be charged separately.
12. Availability and maintenance
DutchSpark makes reasonable efforts to keep the service available and secure. Temporary maintenance, updates, security measures, outages at hosting providers, DNS providers, external websites, FTP/SFTP servers or internet connections may affect availability.
13. Customer responsibilities
The customer is responsible for correct content, rights to images, text and trademarks, secure passwords, correct credentials, internal authority and compliance with applicable law. The customer reviews changes before publishing.
14. Security
DutchSpark applies reasonable technical and organisational security measures. Credentials are stored encrypted wherever possible. No system can guarantee complete security. Suspected misuse, data breaches or unauthorised access must be reported immediately through the support form.
15. Intellectual property
All rights to DutchSpark CMS, software, templates, documentation, UI, scripts and developed modules remain with DutchSpark or its licensors, unless otherwise agreed in writing. Customer content remains the property of the customer or rights holders.
16. Liability
DutchSpark is not liable for indirect loss, consequential loss, loss of revenue, loss of data, missed savings, reputational damage or damage caused by incorrect content, incorrect credentials, external hosting, DNS, plugins, scripts or third-party changes. To the extent that liability cannot legally be excluded, it is limited to the amount paid for the relevant service in the three months preceding the damaging event, with a maximum equal to the amount paid by the liability insurer.
17. Privacy and processing of personal data
When using the CMS, personal data may be processed, such as account data, log data, support information and technical data from connected websites. The privacy statement and any data processing agreements describe this processing in more detail.
18. Termination and suspension
Termination, term and renewal follow from the quotation, plan conditions or additional agreement. DutchSpark may temporarily suspend access in the event of misuse, payment arrears, security risks or violation of these terms.
19. Changes
DutchSpark may amend these terms. Material changes will be communicated in good time through the website, email or a CMS notification. Continued use after the effective date is subject to the amended terms.
20. Governing law
These terms and agreements with DutchSpark are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
